1. Scope

These General Terms and Conditions (AGB) govern all orders placed through our website and physical storefront. Our services are tailored to both individual consumers (B2C) and business entities (B2B). By placing an order, you acknowledge and agree to these terms in full.

3. Pricing

All prices are listed in Swiss Francs (CHF) and include the statutory Value Added Tax (VAT) of 8.1%. Prices are subject to change without prior notice. The price applicable to an order is the one displayed at the moment the order is finalized. In cases of obvious pricing errors, we reserve the right to cancel the affected order.

4. Contract Formation

The presentation of products on our website constitutes an invitation to offer, not a legally binding proposal. By submitting an order, you make a binding offer to purchase. A legal contract is formed only upon our dispatch of a formal order confirmation email. We reserve the right to decline orders at our discretion.

5. Payment

We accept major payment methods including Visa, Mastercard, American Express, TWINT, PostFinance, PayPal, and bank transfers. Payment is due immediately upon ordering. All transactions are processed via secure, industry-leading third-party payment processors to ensure your data remains protected.

6. Shipping

Shipping details and rates are specified on our dedicated Shipping page. The risk of loss or damage passes to the customer upon delivery of the goods to the carrier. Shiraz Essence is not liable for delays caused by shipping carriers, customs processes, or events of force majeure.

7. Returns

We offer a voluntary 14-day return policy for unopened and sealed products. Please note that under Swiss law, there is no statutory right of withdrawal as found in EU law; this policy is provided as a gesture of goodwill to ensure our customers' satisfaction.

8. Warranty

Warranty claims are governed by the Swiss Code of Obligations (Art. 197 et seq. CO). We provide a 2-year warranty from the date of purchase (Art. 210 CO). In case of demonstrable defects, we will provide a replacement or refund according to Art. 205/208 CO. Warranty does not cover damage from misuse.

9. Liability

Shiraz Essence is liable for damages resulting from intent or gross negligence. Liability for slight negligence is excluded to the extent permitted by law. We are not liable for indirect or consequential damages. Our total liability is limited to the purchase price of the product in question.

10. Intellectual Property

All content on this website, including text, graphics, and logos, is the property of Shiraz Essence and is protected by Swiss and international intellectual property laws. Any unauthorized use of our content is strictly prohibited.

11. Data Protection

Your privacy is paramount. The collection and processing of personal data are governed by our Privacy Policy, which can be found at /pages/privacy-policy.

12. Governing Law

These terms are governed by Swiss law. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded. The place of jurisdiction is Geneva, Switzerland. For consumers, the place of jurisdiction may be their place of residence.

13. Severability

Should any provision of these terms be found invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid provision will be replaced by a valid provision that most closely reflects the original commercial intent.

14. Amendments

Shiraz Essence reserves the right to update these General Terms and Conditions at any time. The version in effect at the time of order placement applies. Material changes will be communicated to registered users via email.
